Permit with conditions and informatives as outlined in the agenda subject to the following additional conditions and informatives:
6. HOURS OF OPENING
The use hereby permitted shall not include any sale of fuel and provisions to customers outside the following times 06:00 to 23:00 (Monday to Sunday) and the car wash shall only be used between the hours of 07:00 to 20:00 (Monday to Sunday).
Reason: To safeguard the amenities of the locality in accordance with Policy DM5 of the Elmbridge Development Management Plan 2015.
7. DELIVERY TIMES
Deliveries to and collections from the premises including the delivery of fuel, shall only be carried out between 08:00 hours and 19:00 hours on Monday to Friday and between 09:00 hours -18:00 Saturday and 10:00-13:00 Sundays and public holidays.
Reason: To avoid adverse impacts on health and quality of life from noise in accordance with DM5 of the Development Management Plan 2015 and paragraph 123 of the National Planning Policy Framework and the Noise Policy Statement for England.
8. TREES TO BE RETAINED
All existing trees, hedges or hedgerows shall be retained, unless shown on the approved drawings as being removed and paragraphs (a) and (b) below shall have effect until the expiration of 5 years from the first occupation of the development.
a) no retained tree, hedge or hedgerow shall be cut down, uprooted or destroyed, nor shall any retained tree be pruned other than in accordance with the approved plans and particulars. Any pruning shall be carried out in accordance with British Standard 3998: 2010 (tree work) and in accordance with any approved supplied arboricultural information.
b) if any retained tree, hedge or hedgerow is removed, uprooted or destroyed or dies, another tree, hedge or hedgerow of similar size and species shall be planted at the same place, in the next available planting season or sooner.
Reason: To protect and enhance the appearance and character of the site and locality and reduce the risk to protected and retained landscape features, in accordance with Policies DM2 and DM6 of the Elmbridge Development Management Plan 2015.
9. BIN STORE
Prior to the construction of the bin store, detailed plans and elevations of the bin store including details of the proposed roof shall be submitted to and approved in writing by the Local Planning Authority. The bin store shall be implemented as approved and maintained thereafter.
Reason: To ensure a satisfactory design for the bin store and to reduce the potential for odour pollution in accordance with policy DM5 of the Elmbridge Development Management Plan 2015.
3. The sales area hereby approved shall not exceed 88.2 sqm as set out on the approved plans to ensure there would be no impact on amenity or congestion.
4. The lockers hereby approved shall not be increased in numbers or size to ensure there would be no impact on congestion or overdevelopment of the site.
5. Clear signage shall be provided when the station is shut for fuel deliveries.
6. The car wash hours as set out in the hours of opening condition are the same as originally approved in planning application ref 1982/1088.
