                    Two late letters of objection had been received.


                    The Sub-Committee was addressed by Mr. Scott, an objector and Mr. Davies, on behalf of the application.


          Permit with the conditions and informatives as outlined in the agenda, subject to the receipt of a satisfactory legal agreement securing a late viability review mechanism and the final contribution towards the car club scheme within three months of the Sub-Committee’s resolution along with the following additional condition and the removal of Condition 7 (INTERNAL VENTILATION TO RESIDENTIAL DWELLINGS).


          Add Condition:


          Prior to first occupation of the commercial units, a detailed scheme shall be submitted to and approved in writing by, the Local Planning Authority setting out how the commercial kitchen extraction units for any A3 units shall be designed and constructed so as to control odour.


          The scheme approved by the local Planning Authority shall be fully implemented in accordance with the approved details, before the use commences. The works and scheme shall thereafter be retained, in accordance with the approved details for so long as the use continues.


          Reason: To preserve acceptable living conditions of the future occupiers of the residential properties in the vicinity by prevention of odour emissions in line with the requirements of Policy DM5 of the Development Management Plan 2015. 


          In addition, the Sub-Committee agreed that should a satisfactory legal agreement not be completed within 3 months of the Sub-Committee’s resolution, delegated authority be given to the Head of Planning Services to refuse the application for the following reason:


1. The proposal would, by reason of the lack of a Unilateral Undertaking in relation to a financial contribution for affordable housing and car club, be contrary to the requirements of Policy CS21 of the Core Strategy 2011, Policy DM7 of the Development Management Plan 2015 and the Developer Contributions Supplementary Planning Document 2012.
